ARTICLE 1 – RIGHT OF WITHDRAWAL
The Client may exercise the right of withdrawal within 14 (fourteen) days from the date the contract for the service purchased remotely is concluded, without providing any reason and without paying a penalty. To exercise the right of withdrawal, it is sufficient to provide written notice to the Service Provider within this period via email to info@yavuz-uyanik.av.tr or by phone at +90 212 351 30 50.
ARTICLE 2 – CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
In accordance with the relevant provisions of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services where performance has begun and been fully completed prior to the expiration of the withdrawal period, with the Client’s express consent.
The Client acknowledges that, due to the nature of legal advisory services, the right of withdrawal cannot be exercised if the Client has explicitly consented to the performance of the service and the service has been fully performed based on such consent. If performance of the service has not yet begun, the right of withdrawal may be exercised within the 14-day period without any deductions.
ARTICLE 3 – CONSEQUENCES OF EXERCISING THE RIGHT OF WITHDRAWAL
3.1. If the Client exercises the right of withdrawal within the prescribed timeframe and in accordance with the proper procedure, the Service Provider shall refund all payments collected from the Client without any deductions within 14 (fourteen) days at the latest from the date the notice of withdrawal is received.
3.2. The refund will be processed through the payment method (credit card) used by the Client to make the payment. The time it takes for the refund to appear in the bank account is subject to the relevant bank’s processing procedures and is not the responsibility of the Service Provider.
3.3. If the performance of the Service has commenced with the Client’s consent within the withdrawal period and the Client exercises their right of withdrawal after this point, the amount corresponding to the portion of the Service performed up to that point may be charged to the Client; the remaining amount will be refunded.
ARTICLE 4 – CLAIMS AND OBJECTIONS
The Client may file a claim with the Consumer Arbitration Boards or Consumer Courts regarding disputes arising from these terms and conditions.
